Malpractice Results in Months of Cancer Treatment on Wrong Breast

A 40-year-old woman in Rimini, Italy has filed a lawsuit against her local health authority for $1.1 million after she discovered she had undergone months of invasive cancer treatment on the wrong breast.

The woman began chemotherapy and radiotherapy treatment after undergoing an operation for a cancerous lump on her left breast. However, it was only after she had endured 4 months of chemotherapy and undergone 22 radiotherapy sessions at an oncological hospital in Rimini that she had noticed a burn mark on her right breast, which was healthy.

After confronting her doctor, she learned that she had in fact been undergoing treatment on the wrong breast. According to her attorney, the doctor’s negligence resulted in “a reduction in the possibility of the patient’s survival by no less than 20%.”

Medical Malpractice in Florida

Medical malpractice occurs when treatment by a health care provider falls below the accepted standard of care in the medical community and leads to the injury or death of a patient. If a Florida healthcare provider fails to act where others with similar training would have, they may be liable for any resulting damages. Damages in these types of cases may include:

  • Medical expenses
  • Lost wages
  • Loss of earning capacity
  • Pain and suffering
  • Loss of consortium
  • Other damages

Further, when a nurse, doctor or other medical professional acts with gross negligence, or if their conduct is willful or malicious, the injured patient may be entitled to punitive damages. Rather than attempting to make the injured victim "whole," these types of damages punish, and are intented to deter others from similar conduct.
